I had two wisdom teeth extracted at once and the experience was not as frightening as I imagined. The girls were great and accomodating with all my questions and held up the procedure for me until I could talk to Dr. Asher regarding the procedure. I was treated wonderfully and so far I am healing quicker than I expected, plus I left with a thorough set of instructions. I have been coming to Dental I for a while and very pleased with their Doctors and Hygenists. Keep up the great service and I will recommend you to everyone who needs your services. Purpose: To review malpractice claims associated with retained lens fragments during cataract surgery to identify ways to improve patient outcomes. Methods: Retrospective, noncomparative, consecutive case series. Closed claims data related to cataract surgeries complicated by retained lens fragments (1989 through 2009) from an ophthalmic insurance carrier were reviewed. Factors associated with these claims and claims outcomes were analyzed. Results: During the 21-year period, 117 (12.5%) of 937 closed claims associated with cataract surgery were related to retained lens fragments with 108 unique cataract surgeries, 97% against cataract surgeon and 3% against retinal surgeon. Twelve (11%) of 108 claims were resolved by a trial, 30 (28%) were settled, and 66 (61%) were dismissed. The defendant prevailed in 83% of trials. Indemnity payments totaling more than $3,586,000 were made in 32 (30%) of the claims (median payment, $90,000). The difference between the preoperative visual acuity and the final visual acuity was predictive of an indemnity payment (odds ratio OR, 2.28; P=.001) and going to a trial (OR, 2.93; P=.000). Development of corneal edema was associated with an indemnity payment (OR, 3.50; P=.037). Timing of referral and elevated intraocular pressure (IOP) were statistically significant in univariate analyses but not in multivariate analyses for a trial. Conclusions: Whereas the majority of claims were dismissed, claims associated with greater visual acuity decline, corneal edema, or elevated IOP were more likely to result in a trial or payment. Ways to reduce significant vision loss, including improved management of corneal edema and IOP, and timely referral to a subspecialist should be considered. Reasonable care, on the part of a lawyer, is that level of care and skill which, in light of all relevant surrounding circumstances, is recognized as acceptable and appropriate by similar and reasonably careful attorneys.

By David Kulwicki 2016-05-12T17:25:26+00:00April 14th, 2015 A brokerage listed a commercial property for a credit union in 2006 using the WB-5 Commercial Listing Contract. In 2007, the credit union accepted an offer from Mr. A and/or his assigns for $435,100, but the offer never closed. The listing expired July 31, 2007, and Mr. A and/or his assigns was a protected buyer. The credit union sold the property to PW LLC for $410,000 in February 2008. Mr. A is a 25 percent member of PW LLC, and PW LLC was formed during the original term of the listing contract but after Mr. A's offer. The brokerage demanded it commission of $28,700. The credit union argued it did not owe commission because it did not sell to Mr. A and did not know that Mr. A was involved in PW LLC. "Of these errors, failure to diagnose a tumour is soon likely to become the leading cause of claims in Italy, followed by the failure to diagnose fractures. This trend is in line with the tendency already noted in series in the United States 8,131415. Errors are inevitably linked to radiological and medical practice in general, just as they are to all other human activities There is, however, a need to question the possible causes of errors in order to formulate the most appropriate preventive measures (clinical risk management) 16, 17. The insured died of her burns a few hours after the fire. She was insured under a policy providing a $100,000 benefit in case of her death from injury caused by an "accident." The insurance company denied coverage on the ground that the insured had intentionally set fire to her own house and hence her death was not caused by an "accident." In an action under the Employee Retirement Income Security Act, the federal district court awarded the accidental death benefit to the insured's beneficiary. The court explained that "the analysis begins with a determination of the insured's subjective expectation," i.e., whether she expected to be harmed in the fire that she was apparently preparing to set herself. (778 at p. 918.) Reviewing the circumstantial evidence of the insured's escape plans, the court concluded that she "did not intend to be injured; she fully expected to survive the fire and to cash in on fraudulent insurance claims. The facts clearly paint this picture." (Ibid.) Attorneys may place their own interest above and beyond their clients, which may be a breach of fiduciary duty or conflict of interest. The new law further provides that no caps on punitive damages may be imposed if the trial court determines: 1) the defendant intentionally committed the act causing harm to the defendant, 2) the defendant has been convicted of a felony arising out of the same act that is the proximate cause of the plaintiff's damages, or 3) the defendant was under the influence of alcohol or drugs when committing the act causing harm to the plaintiff. 69 After the appellant was disbarred in the State of Washington, the Idaho State Bar instituted reciprocal disciplinary proceedings. The appellant contended that alleged procedural irregularities in the Washington disciplinary proceedings deprived him of due process. The Idaho Professional Conduct Board found that the appellant had not been deprived of due process in Washington and recommended a reciprocal sanction of a 180-day suspension from the practice of law to run concurrently with the disbarment imposed in Washington. We affirm the findings of the Professional Conduct Board and adopt its recommended sanction.
